The earliest written record of Samuel in DE is in the 1800 DE Census Records. He is mentioned in the Deed W2 p441 June 4, 1801 where he is the Grantee of the "Meldrum" farm from the Grantors Benjamin and Elizabeth Flintham and Richard and Christiana Flintham. Both Elizabeth and Christiana were Meldrums and inherited equal parts of this farm with their sister Rebecca the wife of Samuel. Joseph Meldrum their brother had inherited the farm from his father Robert. Joseph died without issue. The farm reverted to the three sisters, then Samuel bought out the other 2/3 interest.

This was part of a larger picture of land acquisitions by Samuel. There could well be earlier dates for the properties in the Middletown area. Looking into the names listed in the Will as to the connections to Samuel's earliest record of moving to DE.

Samuel Penington's will probated Dec 31, 1823 DE Archives New Castle Co. DE: [copied and interpreted to the handwriting}

"In the name of god Amen. I, Samuel Penington of Saint Georges Hundred New Castle County and State of Delaware being indispond of Body but of a sound and disposing memory thank be to almighty God for all his Mercy do make this my last will and testament revoking all others.

Item, I give and bequeath unto my dau. Margaret B. Cochran all my farm situated on the river in Appoquinimink hundred known by the name of Sedgefield containing two hundred acres more of less Conditionally owned that my said daughter Margaret B. Cochran do convey and make over unto my son Samuel Penington all her right claim and title in assigns to the farm where I now reside known by the name of Meldrums farm to her heirs and assigns forever.

Item, I give unto my son Samuel Penington all that part of a track where I now reside known by the name of Meldrum farm containing eighty acres more or less, and also the lands adjoining the Meldrum farms which I purchased of William Frazier containing one hundred and seventy five acres more or less to him the said Samuel Penington his heirs and assigns forever.

Item, I give unto my son John Augustine Penington all my real property in Middletown consisting of the stone house, dwelling house, carriage making shop, and the shop now occupied by W. Sutey and the lot of land attached to the above housing and lots containing five acres more or less, with all my right title and interest to the undivided track or parcel of land purchased in company with Otten Davis and William H. Crawford from the Sherriff of New Castle County adjoining the afor said houses and lot to him my said son John A Penington his heirs and assigns forever.

Item, I give and bequeath unto my daughter Lavinia all that house and lot situated at Cantwells Bridge which I purchased of William Pollard to her heirs and assigns forever.

Item. I give unto my sons Samuel and John A Penington all the stock that I hold in the bank of the United States and also in the Elkton Bank of Maryland to be divided equally.

Item, I give and bequeath unto my daughter Lavinia the sum of four thousand Dollars to be paid to her by sons Samuel and John A Penington share and share a like with interest to be paid to her at the age of sixteen years for which payment the lands willed by me to my sons Samuel and John A Penington and to Lavinia also.

Item, It is my wish that my personal property except my Bank Stock which have bequeathed unto my sons Samuel and John A Penington to be sold and after all my debts be paid, the balance to be divided between my sons Samuel and John A Penington share and share alike.

Item, It is my wish that the partnership now existing between my nephew Augustine H Penington and myself shall be continued under the direction of Augustine H Penington on the same conditions as in the agreement entered into by Augustine H Penington and myself and the meat profits to go to my two sons Samuel and John A Pennington share and share alike.

Lastly, I do hereby authorize and appoint and constitute John Merritt and Augustine H Penington to be the executors to this my last will and testament. I do hereby declare that the within and foregoing instrument of writing to be my last will and testament witness my hand and seal this fourteenth day of December in the year of our Lord one thousand eight hundred and twenty three (1823)

He signed this will ten days before his death.

This Samuel is mentioned in Captain Samuel's obituary in the Middletown Transcript. He is also mentioned on the Penington Chart, which states he was a farmer near Odessa, DE.

Samuel married three times in DE. He is buried in Old Drawyer's Church Cemetery the sixth marker just to the left of the front door as you face the building. He is buried next to his first wife Rebecca Meldrum who died at age 22 years. She is next to several gravestones one is her brother Joseph Meldrum, then her father and mother.

The history for Old Drawyers Church includes that the bricks were made on the "farmland of Robert Meldrum, now owned by Samuel Pennington." It also says the impressions of the kilns are still visible. This could be why these family gravestones are so close to the main door of the Church

The obituary of Captain Samuel Penington mentions his half sister Margaret (Mrs. J. T. Cochran) that Margaret's mother was Miss Meldrum. Samuel's first wife

Samuel married Hannah McConeghy in 1810 [8 years after his first wife's death in 1802] and she is buried to the south side of the Old Drawyer's Church next to Clarence B. her grandson who died at age 11yrs. Hannah died in 1821 when the future Captain was just 4 years old. Samuel died when the captain was 6 years old.

Samuel married a third time to an Eliza S Armstrong just before his death. There is quite a paper trail on this family mater in the Orphan Court Records at the DE Archives. They produced a little girl, Lavinia. She is mentioned in Samuel's will. There is no mention of his wife Eliza in the will. The documents filed produce testimony that Hyland Biddle Penington was visiting his brother just before he died. Samuel explained to him that he had married Eliza in Smyrna DE and had a "pre-nuptial" agreement with her that instead of the dowagers right of 1/3 of the estate she would receive 200 dollars per year. The family disagreement came when the document filed on Samuel's desk could not be found. Samuel stated to his brother that he thought the Eliza had taken it. The court decided on the 200 dollars per year.

In the probate records DE Archives: There is a court document-filing suit against Augustine H Penington guardian of John A and Samuel on behalf of the orphan court and William B Janvier guardian of Lavinia. There was a major battle over the estate settlement that lasted many years until Augustine Hyland Penington dissolved the partnership, got married, lost custody, and moved to Baltimore. He died there.

Del Archives F161.D29 1911 aV4 has a reference to a Samuel Pennington serving on a Court Marshall committee for the 1C 3 regt. Del Militia dates 29 Jul 1802, and 27 Jan 1810

Land begins at the mouth of a gut which divides between a plantation now held by William Clark formerly Adam Peterson's dwelling running down the north side of Appoquinimink Creek binding on the Several Watercourses thereof to the mouth of a gut which divides the land and plantation for the former dwelling of Elias Naudain. 6/20/1825 B4 569 Margaret B Cochran (Samuel's older half sister) signs over for 1 dollar the farm she inherited from her father on the Levels containing 200 acres. (This deed also mentions the Meldrum Farm that she was living on and was required to pass to her brother). [There is farm located on the map of 1869 on what is now called Strawberry Lane just off the Levels road that is labeled Mrs. Polk. Margaret marries William Polk and was alive until 1874. She also seems to have dwellings in Odessa. On the 1871 map, the land is listed as 200 areas under Vandergrift trustee. There is a house on the property wood frame. The age of the house is questionable as to being the original structure. This could be the site of one of the properties that Samuel owned but not proven.] There is some confusion on what Margaret is actually doing in this deed. If she signed over her rights, was she allowed to live in the dwelling?

Not proven theories:

PP 17-1 p56 has this Samuel married to a Sarah Etherington on Nov 4 1789 in Cecil Co Md. Margaret his daughter by Rebecca Meldrum was born in 1799 [could this Sarah be a first wife that died young and Samuel remaried???] and Sarah's date of death 1/12/1827. It then lists the children Margaret b. before 6/20/1800 [10/25/1779], Samuel and John A

This is not the Samuel who died in 1823 but another that shows up on the census with the Captain at age 23, looking for further info on this second and not directly related to Capt. Samuel] and another nearby with "Capt. Samuel Pennington". On map of 1881, there is a S. Penington SW of Odessa across from the Capt.'s farm; this is the unknown Samuel.

A paper sent by Isabel Coburn in 1999 has research from a unknown researcher:

Ruth Stonesifer's documentation has not revealed the children Sarah M, Mary or Eliza H. Also noted is the Fields name as a possible link to James Fields Pennington.
