Eliza S. Pennington buried at Old Drawyer's 1798- 9/17/1873 (her stone is on the far west side of the church, not too far from Margaret B Polk her step-daughter). She was 75 when she died. Her probated will at DE Archives lists that she was a widow living in Philadelphia and left her holdings to her nieces and nephews, Lambert V., Lydia Ella, Estella P, Edgar G. Armstrong.
Orphan court file of Samuel Penington contains a petition from Eliza S. Penington stating that 'when Samuel died in 1823, he left a widow, your petitioner and 4 children. To wit Lavinia by your petitioner age one year, and the following children by a former wife, John age 4, Samuel age 6 and Margaret married John T Cochran now deceased.' 'That your petitioner and the said Samuel Penington were lawfully married together on the fourteen day of April in the year of our lord one thousand eight hundred and twenty two.' Eliza S was asking for 1/3 of said lands signed 4/15/1824. Document has her signature.
The marriage takes place in Smyrna by Rev. Joseph Osborne according to the orphan file. Eliza was 23 at the time of the marriage; Samuel may have been in his forty's or older. (Margaret his first born by Rebecca was 24 at the time of her father's death.) Still searching for a birth year because the age of Eliza S seemed to be of a major concern to the deposition questions contained in the file. Since Margaret is a key player in many of the legal disputes it seems a little odd that Eliza is buried so near Margaret's family's plot at Old Drawyers, although Eliza is differently buried all by herself.
There are many disputes over the inheritance of Samuel's estate by the family and guardians of the orphaned children. Eliza S. had a 'misplaced' marriage contract between her and Samuel. The rest of the family disputed was whether it was signed, whether it was genuine, and what it contained.
Samuel's niece Mrs. Margaret Pearce (Handy) also testified that there was much to do when Eliza S had her read the marriage contact paper. She wanted Margaret to call her "Aunt". Margaret Pearce stated that the papers were not signed at the time she saw them. She believed that the contract was to be executed in contemplation of their intended marriage and provided for the payment of 200 dollars per annum and that any children born would inherit his estate equally with his other children. The niece also stated that Eliza S asked Samuel to read the contract to Eliza S several times. Then Eliza asked Samuel to read the contract to Eliza's mother, but Samuel refused so to do. She also stated that she never had any conversations with Samuel concerning his affairs during his illness, she did not then see him, having sometime before this removed from his house.
This Margaret Pearce was probably widowed at the time that Hannah died and came from the MD area to help with the children. It is speculated that she left when Eliza became Samuel's wife.
Samuel does mention the child Lavinia as his daughter in his last will signed December 14, 1823 (signed just 10 days before he died) and grants her 4000 dollars plus interest to be paid at age sixteen. She also received a log house purchased of William Pollard in Cantwell's Bridge (Odessa) as her part of his estate.
Eliza's name appears in the probate records of John Augustine Penington that are mixed in with the John A Penington (1821) probate at the DE Archive Microfilm that gives her $400 from his estate.
1829 July 6 Summer term Orphan Court NC Co H1 p 334 Eliza S Penington takes the family to Court for non payment of the annunity. In 1834 Sept 20 case review.It restated that she was to receive 200 per year as long as she remain Samuel's widow. No payment had been made She was due about $2000. Eliza was awarded $2000 right away from a Robert Polk. Note added on botton in different hand writing is Eliza S Pennington had died recored Feb12 1874 in Deed Record D10 p269
These court proceedings could have been discussed over many a desert dish, because Captain Samuel had a marriage contract with his second wife Elizabeth.
