[208] 1872/Dec 28: "On Sunday night last, Mr. F. C. Penington on returning to his home in the country saw a horse and buggy standing in the yard, and as it was very late he told the driver of it, a negro man named John Gibson, that he had better go home. Mr. Penington, then with one of his men went to the stable to put away his horse, and when he returned he found Gibson still in the kitchen, and again told him to go home, as he did not wish his house open after 12 o'clock. The negro replied: 'G___d d____n you, you told me that once, and I shall not go till I get ready.' Mr Penington then struck at him, when Gibson struck him on the back of the head with a loaded whip handle and attacked him with a razor cutting him on the hand, and had not Mr. Penington's hired man interfered, would doubtless have injured him very severely, if not fatally. As soon as he could get up Mr. Penington ran into the house and returned with a revolver. By this time the negro had gone into the yard where he stood swearing and threatening vengeance on Mr. Penington but refused to go away. Mr Penington then shot at him with the revolver, but missed him. Gibson called out to him 'Shoot you son of a B__h you haven't hit me yet.' A second and third shot one of which struck him cause him to hush swearing and get into his buggy and leave, as it was getting rather warm for him. On Monday Mr. Penington entered complaint before Esq. Walker who issued a warrant for the arrest of the negro, Gibson, on the charge 'Assault and battery with intent to kill' and he was committed to New Castle Jail to await trial at the May term of Court."
