Ex-Judge of the court of Cecil County, MD. He was a resident of Philadelphia according to the 'Penington road map chart.'

"Hyland Pennington in Wilm. 27 Mar 1867 in his 91st year- originally from MD but a merchant in Wilm. at 4th and Market, dau Mrs. T. B. Rice (29 Mar 1867 32:36)"

Hyland B. Penington's Probate Will 1867 makes his son Augustine H- Executor. His wife Eliza, son William R and grandson Hyland Robert are mentioned. Mary Ann, Hyland B, Martha E Rice, Wm. R, and George W are also mentioned. It also describes land that he is giving in Cecilton. He asks for the graves to be kept in good repair of his family in Cecilton, St Stephens church and specifically that of Samuel M. his deceased son. Describes one of the lands that border the property on the north by heirs William Pearce decs. This is one of the names Margaret Pearce, late Margaret Handy who lived with Samuel and gave a deposition in the Eliza S. Penington petition for the estate battle in 1834.

History of Delaware p 812; " Captain Henry Read, who commanded the steamboat "Wilmington" to Philadelphia, took charge of Indian King Hotel April 1, 1836, and died there January 2, 1837. Jesse Sharpe was the next and last person who kept it. In 1841 it was bought by the Brinton heirs, by James Canby and Edward Tatnall, and the following year H.B. Pennington &Son, opened a dry goods store in it.

His brother Samuel 1823 'orphan court papers":

There seems to be a wealth of papers in this file. However, there may never have been any record of what happened in the family over the estate settlement and the children's welfare had Hyland B. and Samuel's niece come to the actual court proceedings to testify. Their answers were recorded in Cecilton, MD and submitted to the judge in DE. It is assumed that the other people called by summons were present, however there is no written record of their testimony. Weather the use of dictation was prevalent or the judge just read the written testimony and made a ruling is not known

Hyland was 48 when he was called to testify in the Orphan Court petition of Eliza S. Penington's claim to his brother's estate. Hyland B. was present at his brother's last illness and probably had the key information in the dispute of Eliza S. and Samuel's other family members.

Hyland B. basically explained the story that: Samuel had placed his marriage contract with Eliza S. on his desk. The agreement between him and Eliza was she would inherit 200 dollars per year the rest of her days in lieu of dowagers rights to his estate. Samuel had asked his nephew Augustine H. Penington to look for the paper; however, it could not be found and Samuel thought Eliza had taken the paper from his office. Samuel asked her at one point to "Eliza, give up that paper", when she came into his sick room. She reportedly walked out saying nothing.

The judge in DE Orphan Court found in favor of the respondents (the children of Samuel) and awarded Eliza S the $200 per year.

Buried in the same area as his first wife at St Stephens is a Ann wife of Benj Knoche d 5/16/1860 age 68/2/13 [born abt 1792]

I hope this info helps someone else.

It really helped me as it proved that W.R. Penington listed on the 1850
census for Wilmington was the son of Hyland Biddle Penington originally
of Cecil County, Maryland. as the advertizement page for H.B. Penington &
Son listed Wm. R. Penington and the rest of the info from the census
matches up with the known info on Hyland Biddle Pennington.

I now believe that there is a connection between my William Hyland Pennington
& Hyland Biddle/Beadle Pennington - My William possibly a grandson of Hyland

This is why I think so, I found the Hyland living next door to who I believe
to be William & his parents in the 1850 Wilmington, De. Census. ( The William
H. is shown as 3 years of age) I have recently located my William Hyland
Penington' death certificate which told me he was born 20,Jan 1847

It looks like what you found makes it a great possiblity that the H. B.
Penington in the 1850 census is the Hyland B. Penington, who was born 5 March
1777, son of Robert and Mary Penington and that the William Penington living
next door was his son. I have Hyland B. Penington marrying Edith Henderickson
1 April 1799 by Jeremiah Cosden, dau of Augustine Hendrickson ( -1800) and
Rosamond ( -1804), so that Elizabeth mentioned in the census would I guess
be his second (or later) wife; (as you mentioned) Elizabeth Rothwell, who he
married in 1816. I am sure you thought of all this.

William would be the son of Hyland and Elizabeth. Have you checked the 1860
and 1840 censuses? I wonder of Mary J., William's wife (I assume) was the
daughter of William J. Hayes with whom they are living?
I would be interested in what sort of merchant H B Penington was. I appears
that he had some sort of concern at Cecil Crossrords, Maryland [now
Ceciltown] (South east corner), which he rented from Richard Savin. It was lat
er sold to him (Penington), I believe, after Savin's death in 1800 (sale was
in 1804).

Any information about Mary Penington, sister of Hyland B. Penington, who
married Richard Savin, son of Thomas Savin and Ann of Cecil County, Maryland
would be appreciated. Or anything about any Savin or Benson of that area as
well. Does anyone have the Cecil County, Maryland Peningtons in any kind of
order?
Mary the wife of Robert Penington who were the father and mother of Hyland,
was possibly a Biddle, but have no proof as of yet. I do have some
information about the Biddles as well, but unable to connect them directly.
